So Jerry Smith, the judge who felt it was his prerogative to demand that the Justice Department write a 3-page single-spaced memo explaining Obama's public "judicial restraint" comments, now feels he should overrule another judge so that Planned Parenthood can be refused funding.  

Smith had no authority for demanding the letter, and he was in legal error to inject it into the unrelated case that was before him.  Obama's remarks were not in any court's record, not to Smith nor in regard to any case pending before Smith.  Somebody decided not to make an issue of it, but this guy needs a solid rebuke, or better yet an impeachment.  His impetuous and imperious attitude, combined with an inexcusable ignorance of the law, suggests that if he hasn't committed an impeachable offense yet, he will soon.
