Court reverses the summary judgement decision on ANDA Patent litigation between Ortho McNeil and Caraco Pharmaceutical Laboratories

Caraco Pharmaceutical Laboratories, Ltd. (NYSE Amex: CPD) announced today that a US Federal Circuit Court has reversed a portion of a previously decided summary judgment on ANDA Patent litigation between Ortho McNeil and Caraco regarding Ultracet(R).

The court has remanded the litigation to a lower court for further proceedings. The court did find that a portion of the patent was not valid. Caraco believes in the merits of its case and is evaluating its further options.

Detroit-based Caraco Pharmaceutical Laboratories, Ltd., develops, manufactures, markets and distributes generic and private-label pharmaceuticals to the nation's largest wholesalers, distributors, drugstore chains and managed care providers.
