USPTO issues Notice of Allowance for menadione to prevent skin rash in patients taking EGFR inhibitors

Hana Biosciences, a biopharmaceutical company focused on strengthening the foundation of cancer care, today announced that it has received a Notice of Allowance from the U.S. Patent and Trademark Office for the use of menadione to prevent and treat skin rash in patients taking biologic and small molecule epidermal growth factor receptor inhibitors, such as Erbitux® and Tarceva®, for anti-cancer therapy.

The New York Times: A federal judge Monday threw out two patents on human genes that are linked to breast and ovarian cancer. "The decision, if upheld, could throw into doubt the patents covering thousands of human genes and reshape the law of intellectual property."

Court rules certain claims covering isolated DNA sequences in patents covering BRACAnalysis as invalid

Myriad Genetics, Inc. today announced that Judge Robert W. Sweet of the Federal District Court for the Southern District of New York ruled that certain claims covering isolated DNA sequences in seven of the 23 patents covering BRACAnalysis® are invalid. Myriad will appeal the decision to the Court of Appeals for the Federal Circuit and will continue to vigorously defend this litigation.

Appeals court ruling clears way for Enzo Biochem to pursue claim for substantial damages against Applera

Enzo Biochem Inc. said today that a decision released Friday by the Court of Appeals for the Federal Circuit reversing a district court's summary judgment will enable the Company to pursue a claim for substantial damages against Applera Corporation, now Life Technologies Corporation. The Court of Appeals vacated the lower court's judgments of invalidity on United States Patent Nos. 5,328,824 and 5,449,767.

AGA Medical Holdings announces settlement of patent infringement lawsuit with Medtronic

AGA Medical Holdings, Inc. today announced the settlement of a patent infringement lawsuit between the company and Medtronic, Inc. This dispute relates to the January 2007 patent infringement action against the company, filed by Medtronic, Inc., alleging that substantially all of AGA Medical's AMPLATZER® occluder and vascular plug devices infringe three of Medtronic's method and apparatus patents on shape memory alloy stents (U.S. Patent Nos. 5,190,546, 6,306,141 and 5,067,957, collectively known as "the Jervis patents").

Federal Circuit affirms validity of Pressure Products’ patent infringement case against Greatbatch Medical

In the most recent development concerning Pressure Products’ patent infringement case against Greatbatch Medical’s valved, peelable introducer product line, The United States Court of Appeals for the Federal Circuit has affirmed the rulings of United States District Court for the Eastern District of Texas that Pressure Products’ patents are valid and enforceable. In a split decision, the Federal Circuit remanded the case to the District Court for further proceedings concerning Greatbatch’s infringement of Pressure Products’ patents.
