Gilead Sciences, Inc. today announced receipt of a Paragraph IV Certification Notice Letter advising that Teva Pharmaceuticals submitted an Abbreviated New Drug Application (ANDA) to the U.S. Food and Drug Administration (FDA) requesting permission to manufacture and market a generic version of Viread® (tenofovir disoproxil fumarate).

US PTO grants new allowances to intellectual property covering Neurologix' GAD based delivery systems

Neurologix, Inc., a biotechnology company engaged in the development of innovative therapies for the brain and central nervous system, announced that the U.S. Patent and Trademark Office (US PTO) has expanded the intellectual property protections enabled by a previously issued patent that is central to Neurologix’s Parkinson’s disease program. The new allowances to U.S. Patent Number 765,446, entitled “Glutamic acid decarboxylase (GAD) based delivery systems,” broaden the patent’s coverage beyond Parkinson’s disease to include the use of GAD65 in the treatment of other neurological and related disorders.

USPTO grants Cenestra Health patent relating to high-purity omega-3 fatty acid formulations

Cenestra Health announced today that the U.S. Patent and Trademark Office has issued a key patent related to the company's high-purity omega-3 fatty acid formulations and their methods of use. U.S. Patent No. 7652068, entitled "Omega-3 Fatty Acid Formulations," covers a unique, high-purity formulation of the omega-3 fatty acids EPA (eicosapentaenoic acid) and DHA (docosahexaenoic acid).

U.S. court decision favors Teva in generic Temodar ANDA litigation

Teva Pharmaceutical Industries Ltd. announced today that the U.S. District Court for the District of Delaware has issued a decision in its litigation over the Company's Abbreviated New Drug Application (ANDA) to market its generic version of Schering-Plough’s brain tumor treatment Temodar® (temozolomide). The Court found that U.S. Patent No. 5,260,291 is not enforceable due to prosecution laches and inequitable conduct.

MDRNA granted Chinese patent for use of nucleic acids in cancer treatment

MDRNA, Inc., a leading RNAi-based drug discovery and development company, today announced that the State Intellectual Property Office of the People's Republic of China (PRC) has issued a Notification of Granting Patent Rights for PRC 200480018784 which includes the use of nucleic acids, e.g., an siRNA, for the treatment of cancer. The patent describes modulation of claudins, which are proteins implicated in tumor progression and metastasis.

New U.S. patent broadens Cytori Therapeutics' portfolio covering adipose-derived cell therapies

Cytori Therapeutics today received U.S. Patent No. 7,651,684 (the ‘684 patent) which covers the Company’s methods for delivering adipose-derived stem and regenerative cell-enriched fat grafts into patients. The ‘684 patent specifically covers cell-enriched fat grafts to treat soft-tissue defects and urinary incontinence. In addition, the ‘684 patent covers methods for delivering cell-enriched fat grafts to a patient’s breast, wrinkles, lips, under the eyes, cheeks, chin, and other parts of the body.

ZIOPHARM receives Notice of Allowance for palifosfamide from U.S. patent office

ZIOPHARM Oncology, Inc. announced today that it has received a Notice of Allowance from the U.S. Patent and Trademark Office for Application Serial No. 11/257,766 entitled “Salts of Isophosphoramide mustard and analogs thereof as anti-tumor agents” with claims directed to compounds, pharmaceutical compositions, and lyophilisates. These claims cover the Company’s proprietary palifosfamide composition (ZIO-201 or ZymafosTM). The Company has recently reported positive randomized Phase II sarcoma interim data for intravenous palifosfamide at the Annual Meeting of the Connective Tissue Oncology Society (CTOS) on November 6, 2009 and expects, following U.S. Food and Drug Administration (FDA) review, to initiate a registration trial the first half of 2010.
