Legal-Bay LLC, The Lawsuit Settlement Funding Company, announced today that there has been a rise in applications and substantial funding occurring at the company, despite the fact that the settlement deal has been challenged in court as being insufficient.
Federal District Judge Anita B. Brody had approved the landmark potential $1 billion settlement in the NFL concussion lawsuit in April, hoping to put an end to this part of the litigation, however, according to the NY Times, "a friend-of-the-court brief" filed in August suggests that the settlement "is flawed because it does not cover the full range of physical and psychiatric disorders linked to brain trauma." Lawyers for the Brain Injury Association of America filed a brief with the U.S. Court of Appeal for the Third Circuit, stating that the settlement doesn't recognize or compensate the bulk of the players who suffer "long-term consequences of brain trauma, but merely rewards certain small, discrete groups." They allege that many retired players remain "excluded and uncompensated" under the settlement terms. According to the NY Times, the settlement "is expected to be appealed by up to a dozen sets of players." Despite the question on when the players will receive actual payments, Legal-Bay has seen a steady rise of applications and substantial funding occurring in regards to the NFL concussion lawsuit and settlement, and Legal-Bay is here to help any retired players who need lawsuit money or a lawsuit cash advance prior to receiving their ultimate settlement check.
Patty Kirby, COO and Head of NFL Lawsuit Funding at Legal-Bay, commented on the NFL concussion settlement deal and the rise in applications, "We are happy that the settlement process is underway and that our investing partners are assisting many of the ex-NFL players with getting some immediate cash. Our NFL concussion applications are on the rise due to expected delays of payments from the appellate process. Unfortunately, there is no timetable now as to when funds will actually be dispersed."
Legal-Bay is currently prepared to provide up to $100K on pre-settlement lawsuit cash on serious injury NFL concussion cases. The cash advances are on a non-recourse basis, meaning the plaintiff only needs to repay the advance if the case is successful. Legal-Bay does not buy the full claim, they only advance a portion of the expected settlement amount. Any fees or expenses accrued on the advance will be repaid by the plaintiff's lawyer if and when the case is officially settled and paid.
